NOTICE TO ALL PATRONS

SEVERNA PARK GOLF CENTER – WAIVER OF LIABILITY AND ASSUMPTION OF RISK

PLEASE READ CAREFULLY – BY ENTERING THESE PREMISES, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING TERMS.

  1. ACKNOWLEDGMENT OF RISK

By entering Severna Park Golf Center, located at 1257 Ritchie Highway, Arnold, MD 21012, all patrons, guests, and visitors (“Patrons”) acknowledge and understand that participation in golf, recreational activities, and simply being present on the premises involves inherent risks, both known and unknown. These risks include but are not limited to:

  1. Physical Injury: Injuries from errant golf balls, club impacts, slips, trips, falls on uneven or wet surfaces, as well as interaction with equipment such as practice mats and driving range systems.
  2. Environmental Hazards: Exposure to extreme or adverse weather conditions, including but not limited to rain, wind, lightning, extreme heat or cold, which may result in hazardous playing or walking conditions.
  3. Surface and Terrain Hazards: Accidents caused by uneven surfaces, gravel, wet grass, or slopes that may result in slips or falls.
  4. Actions of Others: Risks resulting from the actions, negligence, or recklessness of other Patrons, players, spectators, or third parties.

Patrons voluntarily assume all risks associated with physical presence and participation in activities at Severna Park Golf Center, regardless of severity.

  1. ASSUMPTION OF RISK

By remaining on the premises or engaging in any golf or recreational activity, Patrons voluntarily and knowingly assume the risks inherent to these activities, including but not limited to:

  1. Playing golf on the driving range, Par 3 course, or practice areas.
  2. Standing, walking, or observing in areas where golf balls are in play.
  3. Attending events, tournaments, or leagues held on Severna Park Golf Center property.
  4. Walking through non-playing areas, including parking lots, restrooms, walkways, and landscaped spaces.

This Assumption of Risk applies to both known and unknown hazards, including those arising from the acts or omissions of Severna Park Golf Center, its owners, employees, contractors, agents, or affiliates.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Severna Park Golf Center, its owners, operators, employees, agents, contractors, and affiliates shall not be liable for any injury, damage, loss, or expense resulting from or arising out of your presence on the premises, participation in activities, or any incident that may occur, including but not limited to:

  1. Personal Injury or Death: Any physical harm, bodily injury, or death, whether resulting from golf balls, clubs, equipment, environmental conditions, slips, trips, falls, or other hazards. This includes minor injuries such as bruises, sprains, and cuts, as well as severe injuries including fractures, concussions, or permanent disability.
  2. Property Damage or Loss: Any damage to or loss of personal property, including but not limited to golf clubs, bags, clothing, electronic devices, or vehicles, regardless of cause, including theft, accident, or damage by third parties.
  3. Medical Expenses: Any and all costs associated with medical treatment, hospitalization, rehabilitation, or emergency response resulting from injuries sustained while on the premises or during any activity at Severna Park Golf Center.
  4. Third-Party Acts: Any injury, damage, or loss caused by the negligent, reckless, or intentional acts of other Patrons, players, spectators, or third parties.

Severna Park Golf Center expressly disclaims responsibility for the actions of third parties, including other Patrons, whether on the course, driving range, parking lots, or other areas.

  1. PARKING LOT LIABILITY

Patrons acknowledge that Severna Park Golf Center assumes no responsibility for any damage to or theft of vehicles or their contents while parked on the premises. Parking is at the sole risk of the vehicle owner or operator. Severna Park Golf Center is not liable for any collisions, accidents, theft, or other incidents that may occur in the parking lot, whether caused by weather conditions, other vehicles, or any third parties.

Patrons are advised to lock their vehicles and secure any valuables before leaving them unattended.

  1. WEATHER-RELATED CLOSURES AND CONDITIONS

Severna Park Golf Center operates under variable weather conditions. Patrons are responsible for taking precautions during adverse weather. Severna Park Golf Center reserves the right to close the Par 3 course, driving range, or other outdoor facilities without prior notice due to inclement weather or hazardous conditions. Such closures are at the sole discretion of management and are for the safety of Patrons.

Patrons accept the potential for weather-related closures, delays, or cancellations and agree that Severna Park Golf Center shall not be liable for any inconvenience, loss, or damages resulting from such decisions, including but not limited to:

  1. Slips, trips, or falls due to wet or icy surfaces.
  2. Risk of lightning strikes or wind-related hazards.

It is the responsibility of each Patron to monitor weather conditions and make decisions regarding their own safety.

  1. MEDICAL EMERGENCIES

In the event of a medical emergency, Severna Park Golf Center staff will assist in contacting emergency services. However, Severna Park Golf Center does not provide on-site medical care. All medical treatment, whether administered by emergency personnel or self-administered, is the sole responsibility of the injured party.

Severna Park Golf Center shall not be liable for any medical expenses, treatment costs, or related expenses incurred as a result of injuries sustained while on the property. Patrons are responsible for their own health and safety.

  1. PHOTOGRAPHY AND VIDEO CONSENT

By entering the premises of Severna Park Golf Center, Patrons consent to the use of any photographs, video footage, or other media taken of them while on the property for promotional, marketing, or advertising purposes. Such media may be used without compensation or prior notice.

If a Patron does not wish to be photographed or recorded, it is their responsibility to inform Severna Park Golf Center staff upon entry.

  1. INDEMNIFICATION

By entering Severna Park Golf Center, each Patron agrees to defend, indemnify, and hold harmless Severna Park Golf Center, its owners, operators, employees, agents, contractors, and affiliates from any claims, demands, lawsuits, liabilities, or damages, including attorney’s fees, arising from:

  1. The Patron’s participation in any activities at Severna Park Golf Center.
  2. Any injury or damage caused by the Patron’s actions, whether negligent, intentional, or unintentional.
  3. Any breach of the terms of this waiver by the Patron.

This indemnification covers all legal costs incurred by Severna Park Golf Center as a result of defending any claims brought against it.

  1. AMENDMENTS TO THIS WAIVER

Severna Park Golf Center reserves the right to modify or amend this waiver at any time without prior notice. The most current version will be posted on-site and on the Severna Park Golf Center website. By continuing to enter and remain on the premises, Patrons agree to be bound by any such modifications.

  1. GOVERNING LAW AND JURISDICTION

This Waiver of Liability and Assumption of Risk shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. Any disputes arising out of or related to this waiver shall be resolved exclusively in the courts of  Anne Arundel County, Maryland.

 

BY ENTERING THIS PROPERTY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THIS WAIVER AND RELEASE OF LIABILITY.
